Although i meant assholes in reference to the paranoid pricks who want to protect us from ourselves, the jumpers in question can be blamed a bit too for taking the construction elevator up instead of using the stairs.

If it's an ordinance by the city, then it shouldn't be a jailable offense, just a fineable offense. The state, however, can pass laws that are jailable.

That's probably not the case. Depending on the class of the city, in most states, city ordinances can be violations or misdemeanors. In both cases the peace officer has the power to ensure that the offender appear before the court by detaining him.

In the case of a violation it is usually preferred that the violator be cited and allowed to present himself to the court at a future date. If the violator indicates his unwillingness to do so (like wadding the citation up and throwing it away), the peace office will generally compel the violators presence by arrest.

By the same token, though it is generally preferred that offenders (those committing criminal offenses) be arrested, on a misdemeanor charge, if the peace officer believes the offender WILL present himself before the court, he MAY cite the offender to court rather than arrest him.

The two points being that cities generally do have the power to create criminal law, and that those enforcing laws have some discretion in whether to cite or arrest. If you are reasonable, local, sober, and ask nicely, you may be able to talk yourself into a citation rather than a trip to jail. And if you are the opposite, you can certainly talk yourself into jail.

Well, I can assure you they didnt use the stupid elevator...they used the stairs. And you guys wouldnt believe how they got busted anyway.

They executed this jump perfectly and still got busted. The reason its pissing people off and is such a big deal is b.c it exposed Flint Co's SHITTTY "security force".

I just dont get how someone can get 5 DUI's and actually be a threat to people around them and still be felon free. But when we dare to steal some altitude we get F*CKED!! Biggggity babyback bullsh*t!Frown

I'm really glad that the city council is taking all the 'what ifs' into consideration prior to voting to pass legislation that would protect BASE jumpers from the possibility of danger.

"Wind patterns are unpredictable and easily could push a glider into another structure. There's the chance the parachute could become tangled in wires or could malfunction, leaving the jumper to fall hundreds of feet to the pavement, he said."

Obviously they are just looking out for OUR best interests. Maybe they will decide to make alcohol, cigarettes and automobiles illegal too. Those things are wicked dangerous...as is unprotected sex, which I am particularly fond of.

All of which happen in skydiving as well.. I'm sure he isn't lobbying to abolish his local dz.

yeah, any idiot can get themselves thrown into jail for nothing. But as far as I know, cities don't have the power to create laws that can result in *significant* jail time for an offense. When I say significant, I mean a month or more. That's the purvue of the states and the federal government.

Those cops look like the biggest party poopers ever. I bet they hate their jobs. Laugh

BTW this law won't affect base jumping at all, people will still jump from the downtown buildings just as much. Know why? The people who can't afford to get busted already don't jump urban. The ones who can do. So what if they outlaw base jumping? Like its going to be that much more of a difference from getting a misdemeanor/felony trespassing charge?
