Ownership of property and equipment
2 part question...

1. If there is an "A" that is owned by a law enforcement agency, would getting caught jumping it run the risk of increased penalties opposed to if it was owned by a communications company?

2. Same question if it was owned by a company but it had law enforcement equipment on it.

They can attempt to charge you with whatever they want, what sticks is what you agree to.
There was a supreme court judge who once said that there is not one person in jail that did not agree to go. Most would read that and say BS but if you look closely he is right on the money. They need you to sign your name and agree to their contract, otherwise they got nothing. Of course you can't dishonor them and argue because then they have gotcha!
The more I look at our system the more I see that it is all contracts and if you know how they work and how to enforce your contracts you can do A LOT! They do it to everyone, all the time!

laws get violated all the time. it really isn't about that.

it's about someone's motivation to bring you down. if they want to spend enough energy, they will find something to charge you. (the NPS officials have used a law that doesn't seem to apply to BASE quite successfully.)

I've met LEO's that would laugh and might even assist you.
I can also tell you that the last thing you want is an upset LEO that thinks you have somehow "disrespected his authority." that's one way to kick off a vendetta.

most private owners probably care little as long as their equipment remains undamaged and they remain free of legal liability. they generally have things they consider far more important consuming their time.

A communications tower used for either
Law Enforcement or part of the Federal
Emergency response network is hotter.

Chance of getting busted is higher and
the charges are more likely to be stiff
and pressed fully in a court of law.

I have not personally been caught yet...
my statements are based on input from a
good friend (with SKY & BASE jumps) who
works for the man.

Also on this note, say you buy a high rise condo... Is it illegal to jump off of your own balcony?

most towers have police communication equipment on them. however most police do not know this.

avoid any tower that is owned by the federal government.

be wary of towers that have federal communication equipment leased on them.

arrest from jumping a tower may result in a new type of charge: class A misdeameanor for criminal trespass on infrastructure.

if the site is of such concern and if you are interested in a workaround on the issue, consider buying a weather monitoring unit or pollution monitor, contact the tower people, and ask to rent space on the tower. Cost per month goes by weight and by altitude. They won't let you on the tower. They will request that you hire an approved contractor to place the item and for future inspection/maintainance. There may be a provision in the lease contract that allows you to be on the land/near the tower that may defeat pursuit of criminal charges. However, any workaround we may devise will eventually be countered with a work around by the tower people and the legislatures.
