Confiscated Rigs
So I was just thinking about jumping illegal stuff, but my thoughts scared me on getting my rig taken away....Then a question popped into mind.

What do the authorities do with rigs that they confiscate? Do they keep them, trash them, or hold auctions like they do with drug cars?

Anyone know?

it depends.

state and local government... you usually get it back after trial or case disposition unless forfeiture is part of the plea deal/sentence (it usually isn't). what they do with the rigs they do keep... dunno.

federal? as a rule, they take it and usually keep regardless, and confiscation is almost always part of the sentence/plea deal. (Rumor has it a lot of that gear ends up with Forest Service smoke jumper units.)

This is not always the case, however. When the rangers jacked me in Yosemite in 1979, I got my gear back within a month because I was able to prove that i was a parachuting instructor and needed my gear for my profession (back then, skydiving rigs and base rigs were the same rigs).

more recently, i recall that some peeps who got popped in the black canyon got their gear back after trial.

A key condition in ANY case, federal or local: The nicer you are, the less 'tude you display, the greater the chance you'll get your gear back, Cops are pretty much like everyone else; if they like you, they'll be nicer, and if they don't like you, they will look for ways to mess witchoo more...

mostly correct, my experience with evidence for federal cases is after the disposition has been reached (all probation served, all fines paid, ect) the property is legally the person it was taken from. So unless gear forfeiture is part of the plea/sentencing agreement you should be able to get it back. There is usually some redtape that you have to sort through to get the stuff back.

The only time evidence is perm. seized is if it is an illegal item (ie drugs/paraphernalia) or something you are prohibited from possessing (gun for a felon ect)

items legal to posess, but acquired through ill-gotten gains, like cars bought with drug money, can be taken with no chance of return.

buddy of mine just got popped on a legally owned and registered motorcycle, hispeed chase and a felony fleeing to elud and driving on a suspended liscense = siezed motorcycle.
