it depends.
state and local government... you usually get it back after trial or case disposition unless forfeiture is part of the plea deal/sentence (it usually isn't). what they do with the rigs they do keep... dunno.
federal? as a rule, they take it and usually keep regardless, and confiscation is almost always part of the sentence/plea deal. (Rumor has it a lot of that gear ends up with Forest Service smoke jumper units.)
This is not always the case, however. When the rangers jacked me in Yosemite in 1979, I got my gear back within a month because I was able to prove that i was a parachuting instructor and needed my gear for my profession (back then, skydiving rigs and base rigs were the same rigs).
more recently, i recall that some peeps who got popped in the black canyon got their gear back after trial.
A key condition in ANY case, federal or local: The nicer you are, the less 'tude you display, the greater the chance you'll get your gear back, Cops are pretty much like everyone else; if they like you, they'll be nicer, and if they don't like you, they will look for ways to mess witchoo more...
