Famous Lake in the Southwest U.S.
Is getting caught at Lake P. an "illegal aerial delivery" charge even though it's a national recreation area? I recall this being a big issue with Fred Morelli, Dennis McGlynn, and Mark Albers. What was the conclusion from all the litigation?

National Rec areas are governed by nps, along with nat seashores, nat rivers, monuments, etc. The only thing that I know they do not govern is national forests. Thats under the dept. of agriculture. My rule of thumb has always been if it has the word national in front of it, and its not a national forest, they will bust you IF caught.

I believe so. All the same laws (regarding jumping) that apply in National Parks, apply in National Rec. areas. I was busted in a National Monument and I can tell you my above statement is 100% accurate for those areas.

Get in touch with BASE 428, I remember talking with him years ago about the LP jumps. He should have some good input for you.

this case went to the 9th circus court of appeals, where the decision affirming the lower court conviction so eloquently stated that "a parachute is a parachute is a parachute..." in dismissing the argument that parachutes are aircraft as defined by NPS and even though the entire surface of lake p. is an officially designated landing area...
