Speaking Of Close Calls
Jumped a building tonight. Door was alarmed so i geared up in stairwell, got my PC ready and opened the door. Ran to exit point, climbed the 2/3ft ledge and jumped off. In such a hurry that im not sure if my 42 just hesitated on me or my bridle wrapped under a bottom corner. Either way i was bracing for a bad day.

Fun not over when i did eventually open it was a 90 left away from the LZ. Landed uneventfully and a bum took his time to help me load my canopy in the car, then asked for some change. I felt bad as i didnt have any as i dont take a wallet or ID with me on B's

Buildings rock. I think im gonna go look in the mirror now and say a few swear words while laughing to myself.

"First, what the United States Supreme Court said. What the United States Supreme Court held in Hiibel v. Sixth Judicial Dist. Court (2004) 542 U.S. 177, was that a state could make it a crime for a person to refuse to identify himself (i.e., tell the officer his name and address) when lawfully detained for criminal activity. Note that the Supreme Court did NOT say that any kind of identification papers could be required, nor did they say that police officers could ordinarily arrest someone for refusing to identify himself absent a state law permitting that arrest. There is no law in the United States requiring everybody to carry ID, at least not yet.

There is NO law in California requiring anybody to carry identification. There is no law making it illegal for anyone (even someone lawfully detained) to fail to have identification papers or to refuse to identify himself (there was such a law, which was declared unconstitutional). Thus, Hiibel is of no effect in California, since there is no comparable law there. (It is, however, a crime to give a FALSE identification.)

A person CANNOT be arrested just for failing to identify himself or failing to have ID, even with a lawful detention. It is NOT interfering with an officer. The only effect of not having ID occurs if a police officer has probable cause to believe an arrestee has committed a criminal offense. A police officer who could otherwise give an arrestee a citation to appear would instead take the person into custody to appear before a magistrate. But this is ONLY if the officer has probable cause to believe the person has committed a crime--NOT just because the person did not have ID.

Of course, one must have identification in his or her possession when driving, and a police officer obviously can demand to see a drivers license from any driver lawfully detained.

In Tennessee, if a cop stops you and you dont have any State ID, you go to jail. (only 18 and older)

thats a federal law... you can be arrested for not having state or government issued identification on you at any time... stupid law but one that is not very enforced. but deff one more thing they can throw at you. besides, if your solo jumping anything i would take ID in case of injury or death so they can contact someone on behalf of you. i personally would not want to wake up in a hospital with no one around!

I think more to the point is the effect of your not having ID on the police officer's decisions.

In most states, a police officer may choose to write you a citation for trespassing or he may arrest you if he cannot positively identify you or if he has any reason to beleive that you will not show up for your court date. A citation is a courtesy in this case. It is an opportunity to present yourself to the court rather than being presented to the court. It is a courtesy that you will not get in most cases if you do not have identification.

In addition, if you do have the misfortune to come in contact with a police officer, having ID for him to run through the computers gives him a huge measure of comfort in who he is dealing with. If the whole group has ID, he is much less likely to call for two or three other officers to keep an eye on you while he figures out what is going on, and a single officer is always more likely to let you go(in any situation, not just BASE) than a group of officers.

you are right. The law says one thing, the way it really goes down is another. I also carry my ID, and I usually have 60-100 dollars cash on me. And like Green said Insurance card. My lawyer, well I guess I'll get one when I need it. Dont have any resources for a retainer. But my ultimate plan is to NOT get caught. Tongue

on any urban jump these days, i carry 250.oo cash at a minimum, a throw-away fone with only an ICE number stored, and know my lawyers number by heart. ID goes in a ZIPPERed pocket with the cash, seperate from the fone, this ensures it cant be lost.

good luck. getting busted and going to jail for illegal parachute deployments really sucks.

realize that if you are taken into custody, they traditionally take away your cell phone immediately. so any numbers in it will be inaccessible.

* nicrussel stands upon the buildings edge looking at the street below. At the base of the building is a construction zone so full of objects it is not an available out. and that was the last of that building, my lovely B. She qualified 3 different #s. To be fair, the cop was old and I was hopped up on adrenaline and KNEW where I could go and he couldn't.

I have a rainman-like memory for phone numbers, and found myself involuntarily detained recently, thanking god i'm half retarded and could call anyone i wanted.

remember phone numbers, especially land line ones for important people, because you cant call a cell phone collect from prison.

In Moscow, Russia, we always bring ID's and about $20 with us - that's enough to bribe the cops if you get caught and show your ID. If you don't have ID, the stake increases to around $100, or you spend 3 hours in the police station.

But better jump in 3-4 AM, not get caught, and spend your $20 for 2 liters of beer after the jump :) Moscow is a great city as it doesn't have Rudi Giulliani ;)

one trick I used when I was in jail was to call a number that was disconnected. it will forward you to an operator who acts as an advocate for you so the person you're trying to reach doesn't get an automated response and the operator uses your name.

i had a great deal of trouble calling out because my friend's land line number had an area code frequently used by cell numbers. the jail phone system wouldn't let me call it even though it was a land line.

Another thing that everyone should consider is that jail phones only allow "local" calls to land lines. This means that you must have the land line of someone who will accept your collect call and that person must have the same area code as the county jail you are in. This may be a tough thing to do, especially if you are jumping on the weekend and/or at night. I suppose this emphasizes the point that before you go jump, you should talk with a friend who is not on the load or ground crew and knows where you are going to and tell them that if they don't hear from you in an hour (or whatever predetermined time you choose) then they should call the jail which services the area in which you are jumping. Personally, I know very few people with a land line and would be hard pressed to remember anyone's phone number off the top of my head, especially when I'm sitting in the clink.

Also, like someone else said it is a great idea to have your lawyer's (or a friend that is a lawyer's) number memorized. At the very least, he/she will be able to get into the jail to see you and have private/privileged conversations, whereas any of your other friends will likely not be allowed to see you outside of visiting hours. Just my .02.

I hope to never find out, but I expect there are 2 times to get busted...

1) you land in sight of LEO and thus an immediate arrest. any virtual gc probably will never get a "safe" call and should start looking for you.

2) you land, call the virtual gc, then LEO arrives. I'm betting many will have time to hit redial and say "busted."

again, I hope to never find out.

Both times I've had the pleasure of spending a night in jail, once for a DUI and once for BASE, I wasn't getting released until morning no matter who I called and had talk to the jail.
