NYC; a felony?
Can anyone say 100% for sure whether it is a felony to jump in NYC or not? I understand a law was passed to make BASE jumping "illegal", but as far as I know that was already the case? I know the talk was out there, but there are also rumors that by Jeb beating the case he set a legal precedent. Law surely isn't one of my strong points. I live in manhattan and have been going [elsewhere] to jump. With this playground here it would be great to know.

Jeb is grandfathered in, as the law was passed after his fiasco. So if there's a law on the books (which there is) - you can be charged.

This is what I found in 5 minutes:

Reference N.Y. ADC. LAW § 10-126 : NY Code - Section 10-126: Avigation in and over the city

"b. Parachuting. It shall be unlawful for any person to jump or leap from an aircraft in a parachute or any other device within the limits of the city except in the event of imminent danger or while under official orders of any branch of the military service.
i. Violations. Any person who violates any of the provisions of this section shall be guilty of a misdemeanor."

good question... as I said I don't know law, so if someone is please chime in. Additionally I found that law and several others, including the one recently passed... which is just a misdemeanor. Yet there was talk of it being a felony, so which one is it?

N.Y. ADC. LAW § 10-167 : NY Code - Section 10-167: Climbing, jumping or suspending of oneself from structures prohibited

Also referred to as "daredevil law"

Punishment :
d. Any person who violates the provisions of subdivision b of this
section shall be guilty of a class A misdemeanor, punishable by up to
one year in jail or a fine of up to one thousand dollars or both.


so I guess it's not a felony...

and not a crime especially if you can prove that you did not jump, but rather fell off.

But this would beg the question, what were you doing there in the first place, bringing in to play trespassing, b&e, endangering public, and possibly the "climbing" portion of the same law...

as long as it's not a felony, the risks are no different than anywhere else, imho. let's go!!

While standing on a roof...with a masked gunman demanding he will kill you if you don't give up your money...you can either give him your wallet/attempt to fight the assailant..or leap off the building with a parachute(which you wear all the time in New York so you don't get stuck in a tall building like all those unfortunate in the WTC incident) in order to preserve your life.

be charged as felony and convicted as felony is two different thing unless the media gets involved. most felony well be reduce to mistermeaner by the time you go to court (unless it was a judge's daughter), in New York there is enough murder's and rapes to occupied the court system for decade, just don't drag media in

It says A misdemeanor. that means its not a felony. A misdemeanor is like driving with your license suspended. not really a big deal.

I am not an attorney, but I am pretty damn sure that it would be called a felony if it was a felony. Thus being called a misdemeanor makes it NOT a felony.

but I am just using common sense, so results may vary.
