Solicitors? legal help?
So, next time the fucking sierra club rep comes to my door and interrupts my school work, packing, sleeping, zone out session, I am going to give it monopoly money, and squirt it with concentrated essence of garlic.

would this be considered assault?

I understand that this person or any that walks up to my house is an "invitee", which is also annoying and stupid. can I put up a sign that reads "No Invitees" on my lawn? "No Solicitors" does not seem to work.

I guess what I am saying it, from a civil law/tort law/precedence standpoint, can I beat the shit out of a solicitor? what can i do to it without getting in trouble?

even better, what can I do to get them to never come back? One in ten times it is a cute college girl convinced she does not have some misled grip on the world and thinks she is helping by bugging me. in that case she comes inside to discuss my involvement in the environment as well as refreshments and recreation. BUT the other 9 times they are offensive to look at and I close the storm door in their face when I see a clipboard and ratty sandals.

I am still amazed soliciting is legal.

We used to have an issue with solicitors a couple years ago. They completely ignored the no soliciting sign and pointing to the sign and slamming the door in their face didnt work because the same ones would come back next week. Getting a "beware of dog" sign did work however and the few brave souls that still knocked didnt stay long after i opened the door and acted like i was having a hard time holding back my roomates pitbull. Little did they know if would have just humped their leg raw.

I don't think anyone who walks up to your house is an invitee, but that doesn't mean you can coldcock him.

Ask to see the soliciter's permit. Then call the police and report a trespasser. Either that or don't answer the door.

well, from a legal standpoint, anyone who has not climbed a fence or broken through a gate in is an "invitee", at least it could be argued effectively by a lawyer were I to get sued for the things I want to do. While I did not expressly invite them to knock on my door, it is common courtesy to allow them to safely walk to my front door. (fences are not allowed here) Meaning I have the legal obligation to keep my property or property under my control safe for them. There has got to be a way around this.

I really would rather make them suffer/become physically uncomfortable as opposed to them just passing my house by. I feel it is my civic duty to the community.

Soliciters are generally considered licensees, which is a special class of invitee. But assuming you've got a sign out front, they're really leaning towards being trespassers. Just like everyone else, they're bound to obey your sign or suffer the consequences.

Well, if you do someone bodily harm, whether that person qualifies as an "invitee" or as a "trespasser" won't have anything to do with what is done to you on account of your actions.

There is. Check the local ordinances and find out if a permit is required. Put up a "No Trespassing/No Solicitation" sign. Then, every time someone comes up on the property, tell him to leave and not come back. If someone does come back (or the same organization comes back), call the police.

You don't have to be held hostage by soliciters.

Well, that's a different matter. I once knew a guy whose answer to the solicitation problem was to answer the door naked...while stroking a raging erection. Although the tactic seemed to work, it was also the violation of a criminal statute. Luckily, none of his "victims" ever filed a complaint against him.

You might try to work up your own personal Tom Mabe routine and do that when you answer the door. If you're creative enough, I'm sure they'll run screaming.

I thought for them be a licensee I needed to agree to do business with them. hmm... ok, well, that is even worse? I thought that licensees have more rights than a invitee. I'll read it again.


we never figured out of I could squirt them with a squirt gun, be it filled with water or irreversibly staining ink (to destroy what documents they carry as well as make their clothes less desirable). probably ink. but then I also have to handle it. getting complicated.

Don't do anything physical, except to shut the door in their faces. Anything else could constitute assault.

I know you want to do something more direct. You can't unless you're willing to go to court/to jail for it.

We used to get jehovah's witness and mormon's constantly, they just couldn't take a hint slamming the door, abusing nothing would work....

Then I started answering the door naked.... its been peaceful ever since.

I do believe that beating the shit out of someone will make you guilty of the tort of Battery, absolutely regardless of their trespass/invitee/licensee status. Even if they trespass you still owe them a limited duty of care. Basically kicking the shit out of anyone will only be justifiable in self defense. Or so I think :)

Answer : No, you cannot beat the shit out of them for just soliciting. You can tell them to leave, at which point if they don't, they become a trespasser and you can call the authorities to remove them.

Another reason to hate the sierra club... they are a main reason BASE is illegal in Yosemite Mad

I just had finished spending 3 weeks for 10 hours a day doing my fall semester, I did not know what to do with myself so I got on dorkzone. Forgive the trolly maneuvers, I know I cannot beat the shit out of them, I just need to get rid of them. besides, I am all talk. The rudest thing I do to them is shut the door in their face. I really never could hit someone.
