WV ticket holders - question for all you lucky ones
hey, those of you lucky enough to interact with the cops on Thursday - can you post the exact charge w/ the numbers that are written after it ? I remember looking at one persons ticket and it said trespassing and gave a penal section 60 something or other

sorry, it took so long... couldn't find the crumpled up ticket that was mixed in with the other trash on the floor of my truck.

(a) Any person who knowingly and without being authorized, licensed or invited, enters or remains on any property, other than a structure or conveyance, as to which notice against entering or remaining is either given by actual communication to such person or by posting, fencing or cultivation, shall be guilty of a misdemeanor, and, upon conviction thereof, shall be fined not more than one hundred dollars.

(b) If the offender defies an order to leave, personally communicated to him by the owner, tenant or agent of such owner or tenant, or if the offender opens any door, fence or gate, and thereby exposes animals, crops or other property to waste, destruction or freedom, or causes any damage to property by such trespassing on property other than a structure or conveyance, he shall be guilty of a misdemeanor, and, upon conviction thereof, shall be fined not less than one hundred dollars nor more than five hundred dollars or imprisoned in the county jail for a period not to exceed six months, or both such fine and imprisonment.

(c) If the offender is armed with a firearm or other dangerous weapon with the unlawful and felonious intent to do bodily injury to a human being during his commission of the offense of trespass on property other than a structure or conveyance, such offender shall, notwithstanding the provisions of section one, article seven, chapter sixty-one of this code, be guilty of a misdemeanor, and, upon conviction thereof, shall be confined in the county jail for a term not to exceed six months, or fined not more than one hundred dollars, or both such fine and imprisonment.

(d) Notwithstanding and in addition to any other penalties provided by law, any person who performs or causes damage to property in the course of a willful trespass shall be liable to the property owner in the amount of twice the amount of such damage: Provided, That the provisions of this article shall not apply in a labor dispute.

Of course they took my wife's ticket when she paid it, but I believe this was the same code, though the written charge was "Trespassing on State Property" which is a different violation code.

I would also point out that I asked the magistrate if this was a crime or a violation, and was told it was a violation. This clearly shows it as a misdemeanor crime.Mad

while it is apparent that WV is full of breathtaking views and landscapes and maintains some quality upstanding citizens... it is also evident that it holds more than it's fair share of complete idiots and creepy inbreds.

the way I read it, the jumpers exposed the animals on the property to harm by opening their gate, hopped fences and went past the clearly posted no trespassing signs or came there with weapons intending to cause harm to another human (pick one)

I'll quit ranting after this, I promise.

The yellow gate at the top was open and the sign reads "Gate closes at 3:00 PM". (it was about 11am)

The other short gate at the bottom that is always locked was open.

There are no signs.

Many of those cited were NOT jumpers.

This would be worth raising holy hell about except that the local law enforcement would get seriously pissed once they got their hands slapped for writing citations that clearly don't meet the elements. (And they would get their hands slapped if this were pushed). Having pissed and vindictive law enforcement does not serve our purpose and would further compromise a nice object.

So, I'll shut up and let their shitty Karma catch up to them.

They never walked back into the bridge area, they just got on the bullhorn and announced for everyone to come out because we were trespassing and "base-jumping is illegal".

Never once did they actually see anyone on the bridge.

I feel for you and will gladly go to bat for you if you feel you didn't break any laws. Please email me and provide more details on your arrest so that I can see what can be done.

However, you guys did get busted at NOON. Whatever happened to getting up early and jumping before the sun rises or at night? I warned everyone about this in the final email sent to all jumpers on October 12th.

And if it makes you feel better, I heard that "Kestius", the Lithuanian jumper who looks like Arnold Swartzenegger, smacked a female cop on the butt at the Holiday Inn Saturday night and he wasn't arrested.Wink

I hate to change the subject too much, but the following does deal with COPS:

Did the police presence at the Holiday Inn Oak Hill bother you?

I'm already working on a new hotel for next year and things are looking REALLY great so far. Lots more space, plenty of rooms, no cops roaming the hallways sniffing doors.

Here's my list of complaints:
-Cops were going door to door sniffing for drugs.
-Unauthorized vendors (local bums) selling T's in hallways.
-Cops hanging out in front of hotel issuing tickets to jumpers when they walked 5 feet out the door w/ an open container.
-Cops in my rented ballroom on Saturday night.
-Bubba the security guard (off duty cop) getting in my face Friday night
-Bubba getting the cops to chase Flummi and Aiello out of lower hallway (supposedly blocking exit doors?).
-Cops hanging out waiting for drunk drivers.
-5 dogs max was not in my contract, causing stress for jumpers who brought dogs. Some jumpers were in tears.

Thoughts? Beckley is only 13 miles further from the bridge and a lot closer to the Charleston airport. There's a lot more to do in Beckley and you'll be really close to those OTHER bridges, so getting busted there will be more convenientWink

hell yes. you know many of us are in total agreement with you Jason.

definitely a lot more to do in Beckley and it makes little difference to be further away from the bridge.

my only problem is, i think i'm now a wanted man in Beckley.Crazy

Jason thanks so much for the all the hard work you put in for us. Would love a different hotel. The cops were thicker at the hotel than the Homeland Security at the bridge.

I heard he was just giving her a 'good game' swat. But the male officer with her didn't care much for it. Was it just me or did she look like an older Shawn Johnson?

As for the unifomed officers - that was a surprise to me. Not necessary at all. Isn't the hotel private property anyway?

On a real note Shocked, Beckly sounds like a good place to get a hotel.... I bet the locals might change their tune slightly if they found we were looking at staying in Beck..... ?

I stayed in Beckley on my first BD.

the main problem will be transport.
- staff leaving even earlier/returning later
- a loooong ride on the boom truck
- adrenalized jumpers impatient to get there
- harder to hitch a ride back (wet, separated from ride there, etc.)

but honestly, I do not care. I'll follow your lead. whatever you believe is best, I'm good. you've made good calls to date and deserve our trust.

Well, don't think we haven't analyzed that concept in the (recent) past, as have other jumpers. If you've ever seen the movie "A Bug's Life", BASE jumpers are the ants. If we get bullied too much, I'll dig deep into my playbook and things will get very, very intere$ting.

As for Auburn, they are in fact trying to have their own little BD in the near future. It appears there is some resistance from local communities that utilize the bridge and everyone wants their "cut" of the profits. Californians!

It's hard to say if it's best to fight nor not to fight the tickets. On one side we have the local law who will be pretty pissed off if we stick it to them for blatantly taking advantage of out-of-towners. On the other side we still have the local law, who will probably get even more out of hand if we let them keep doing this to us. This year I felt like I was being herded - the cops were out in full swing, and kept chasing us from objects and herding us back INSIDE Holiday Inn.

2 years ago we had a few cops show up towards the end of the party, sniff some MJ and go hunting. Last year I believe we had them sporadically show up. This year they were at the Holiday Inn full time, pretty much patrolling the hallways and were harassing people outside. This was my 6th BD, and the first 3 years I don't remember seeing them at all.

If we do leave Holiday Inn/Fayettville - how would that affect the locals who are currently supportive of BASE ?

If there are legal/safety issues, by all means call them in, but there was absolutely no need to have them patrolling the hallways "protecting" us.

Not a chance... that bridge is not suitable for a mob of low time skydivers doing a BASE jump for the first time.
