Defamation is written or spoken injury to a person or organization's reputation. Libel is the written act of defamation, vs. slander, the oral act of defamation.

You often hear "Truth is the perfect defense against libel." A curious notion, not entirely supported by what goes on in the courts. Truth is a very good defense. It may prove an unshakable defense if you have $50,000 for lawyers to defend against a defamation lawsuit. If you don't feel like being on the frontier of legal theory, you should build a somewhat better defense. Add on these concepts:

Avoid the impression of malice.

State the facts, and then state your opinion separately. This keeps things clear in your mind.

All wrong: "My neighbor John Smith is a stinking lush." This is wildly defamatory: an unproven, judgmental ("stinking" and "lush" instead of "alcoholic") statement about a private individual.

Getting better: "Governor Smith consumed 14 glasses of whiskey last night at The Watering Hole Bar. In my opinion he's an alcoholic." The proof is a bit hazy – getting drunk once does not prove alcoholism – but a governor is a public figure with less protection than John Smith, you have clearly separated fact from opinion, and there is no particular evidence of malice.

Pretty safe: "Governor Smith consumed 14 glasses of whiskey last night at The Watering Hole Bar. I wouldn't be surprised to learn he's an alcoholic." This is entirely fact, with no clear evidence of malice, about a public figure.

What defamation is not.
Generally, a statement made about an undefinable group of people or organizations cannot be defamation. Take, "Real estate agents are crooks." It's defamatory enough, but there is no identifiable victim.

"Most of the agents at Smith Real Estate Company are crooks" is getting dicier, but it is still hard to define the victim.

"Smith Real Estate Company is a crooked company." Wham! You have a victim: Smith Real Estate Company.

this thread has a potential to be banned. it appears to be a personal attack, but I think this thread can allow people to vent and rant about certain ethical issues.

let's see how it goes.

I've moved it to "The Hangout" allowing a bit more freedom of expression.

Why are you showing such hostility towards Jeb? Do you believe countersuing the ESB makes him a bad person? Are people upset because they think the lawsuit(s) are frivolous, or is it possible bad publicity for BASE in general? Or is it something else that I am missing entirely?

He got sued for a lot of money. Having to pay up $12mil would financially devastate him. A countersuit could potentially solve this problem, and maybe he can even get some money for his landing ramp.

If Jeb wants to build his slide, let him build it. What's wrong with that? People may have their own opinions on whether it will or will not work, but Jeb is the one who is going to use it, and I would guess he is willing to accept the risks involved. So, what is the big deal?

It was the reckless endangerment charge that didn't stick. This was a criminal charge that was dismissed due to Jeb having done his homework. The $12M is a civil matter brought by the ESB management company.

I have met him a few times but wouldnt ever jump with him. I wouldnt want to be a part of his circus, plus I have more than 25 skydives and dont have huge tits, I am not Geraldo, and dont have any ties with CNN or NBC so I dont think he would want to anyways.

I also think you can judge people by their actions, I have never met the president but I think he is an idiot.

Jeb is sticking up for himself--and if you were in his shoes and had the means, ask yourself if you wouldn't be doing the same thing. 98% of what we all know is from media and conjecture. If you went in on a jump and the media decided to call it a suicide, would you want us all to believe it?

the lawsuit(s) have already engendered several threads. some need to vent. those people tend to start new threads.

also, we mention "BASE ethics." a positive discussion can help lead to a community consensus. how do we determine right or wrong?

as evidenced by all the camera angles, Jeb's ESB adventure appears to be a publicity stunt. that means good AND bad. he is receiving the same treatment as Felix, Agnos, or numerous "stars" of a variety of youTube clips... (except some folks defend Jeb.)

I expect we will NOT see Jeb respond. silence probably is better from a legal standpoint.

Totally agree also, this Thread should Not be locked as a personal attack. The person who stated that 'He thinks' Jeb is a Douche is entitled to his opinion and criticism. Just like Jeb is 'Free' to choose the objects of his desire and path to BASE jump off them. That's what BASE is about. If you have the desire, then make it happen and jump it or shut the fuck-up and Watch.
The world is a pretty big playground and BASE is almost non-existent in comparison to size to all other activities played on it. The Media seems to blow it up bigger than real life. It's just one guy, one building and one BASE jump (I am sorry to say) that was stopped before it became a jump.
(IMHO) good on him and anybody else that wants to hit the ESB. It is a once in a life time jump. so Go for it.

If people need to vent that's great. But re-read the rules first. I'm having trouble seeing how calling someone "the biggest douche in the universe" is not a personal attack. Continue reading the whole rules section if you don't get this. The same point could be made without using the "attack" language or even using his name!

I find it sad that this attention whore is what most whoffos think about our sport.

This "femine hygiene product" bag (Ha, can't ban me for that!)

- Dayblazes the highest profile object, after 9/11, wearing all black. Whoffos can only assume they are going to watch a suicide with their children.

- Gets busted because his friends snitch him out.

- Offers to tell the ESB and building owners how easy it would be for them to protect their rooftops and exit tops.

- Sues the ESB for $30 MILLION, because he got sad and emotionally scarred after he got cuffed. (And I think it was BS for them to cuff him, but...)

- Goes on every TV show and network to satisfy his BASE-community-disconnected ego stroking.

- Fails to understand the consequences for his actions during and after to the BASE community as a whole, much like Felix.

- Still rides the "I'm going to land a wingsuit next month" campaign. Do it or STFU!

Jeb, congrats for trying the ESB. But it disgusts me to think that a BASE jumper has finally sued an object owner. I don't have unlimited funds to hire dirtbag attorneys to fights charges, and even if I did, I would take it quietly like a man. With this single action, I know you don't give a crap about the BASE community. At least Felix makes a living off his exploitation.

AND STAY OFF THE NEWS AND CNN. You might think you are the coolest guy in the world, but 95% of the country thinks you are a suicidal, selfish, arrogant, childish piece of crap that could have killed them while they walked innocently down 5th Ave. Looks like most BASE jumpers think you are a POS too.

When did passing the lube and assuming the position become the manly thing to do?

I understand that if you're caught jumping, you're caught jumping, and fair is fair. But $12 million for an attempted jump? There's a whole spectrum of possible legal repercussions between gear confiscation and 20 years in prison. That you would suck it up and take the first doesn't mean you'd be wise to do the same with the second, or with any arbitrary outcome in between.

Once again... If this were some random jumper facing a $12 million fine for standing at an exit point, gear on, in the Valley, would you tell him to "take it quietly like a man"?

You're right.

To become a laughing stock, aired on every news network and comedy show, by retaliating with a $30 million lawsuit against the owner of the private property building that you were trespassing on, sounds like the right thing to do. Jeb doesn't understand that he doesn't have a "right" to jump off someone's building, any more than he can walk into my house and stand on the roof. A little different than every American's National Park.

I admire Jeb for improving the image of BASE jumpers in this country. Maybe one day, we'll try to open the National Parks, and can use Jeb's diplomacy and reasonableness as an example to show the NPS that we really aren't assholes.

I think that Jeb understands that perfectly. He didn't intend to be caught, but he was, and that sucks for everyone, but what's done is done.
I challenge ANY of you to be faced with a lawsuit of that magnitude for getting caught on an urban BASE jump and do anything different. I'm no lawyer, and I (like ANY of us here) really don't know the exact details of the lawsuits, but a counter-suit by Jeb's team may be their only/best option.

Cut the guy some slack or not--I don't really care, but put yourself in his shoes...and then consider if we're being hypocrites or not by flaming him. And then pray you never get caught and hung out to dry.

You may or may not like Jeb, but what is complaining on an internet BLOG going to accomplish?
